La justicia restaurativa y el rol de victima en el proceso penal ecuatoriano

    El objetivo general de la investigación fue analizar jurídicamente la justicia restaurativa y el rol de victima en el proceso penal ecuatoriano. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se empleó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó una encuesta a ciento ochenta y un servidores judiciales en materia penal, inscritos en el Consejo de la Judicatura de Riobamba. Se puede concluir que el modelo de justicia restaurativa apoya un proceso donde las victimas que participan son tratadas de manera justa, con respeto, reciben restauración e indemnización. Con este método se puede identificar las causas subyacentes del delito y desarrollar estrategias para prevenirlo.

    The general objective of the research was to legally analyze restorative justice and the role of the victim in the Ecuadorian criminal process. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was applied to one hundred and eighty-one judicial servants in criminal matters, registered in the Judiciary Council of Riobamba. It can be concluded that the restorative justice model supports a process where victims who participate are treated fairly, with respect, receive restoration and compensation. With this method it is possible to identify the underlying causes of crime and develop strategies to prevent it.
