Resumen de Violación del principio de objetividad en los delitos de robo con violencia sobre las cosas

  El objetivo general de la investigación fue analizar jurídicamente la violación del principio de objetividad en los delitos de robo con violencia sobre las cosas. El método empleado en la investigación, se basó en el enfoque cualitativo, manejando la recolección y análisis de una tipología documental-bibliográfica. La técnica de investigación aplicada fue la entrevista; la herramienta o instrumento que apoyó fue la guía de entrevista. Generándose un proceso analítico–reflexivo. Se concluye que, el rol del Fiscal se ha evidenciado que debe ser un ente imparcial en todo el proceso investigativo, tanto al inicio hasta el final, es así que no debe estar a favor ni en contra del acusado, el cual debe establecer un proceso minucioso de los pormenores del delito, en este caso del delito por robo sobre las cosas; ya que si no cuenta con elementos válidos y confiables para la acusación debe desistir de esta.

  The general objective of the research was to legally analyze the violation of the principle of objectivity in the crimes of robbery with violence against things. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview; the tool or instrument used was the interview guide. An analytical-reflexive process was generated. It is concluded that the role of the Prosecutor has been evidenced that he must be an impartial entity throughout the investigative process, both at the beginning and at the end, so he must not be in favor or against the accused, which must establish a thorough process of the details of the crime, in this case of the crime of theft over things; because if he does not have valid and reliable elements for the accusation, he must desist from it.
