Resumen de El bien jurídico protegido vulnerado en el tipo penal de acusación o denuncia maliciosa

  El objetivo general de la investigación fue analizar jurídicamente el bien jurídico protegido vulnerado en el tipo penal de acusación o denuncia maliciosa. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se concluye que, bien jurídico son los derechos fundamentales inherentes al ser humano mismos que deben ser protegidos por el Estado, entre estos derechos fundamentales se encuentra el honor, el cual crea una condición útil para el desarrollo de la vida del individuo y de la sociedad, es así que la acusación o denuncia maliciosa atenta directamente contra este bien jurídico personalísimo, por ende, es digno de protección jurídica.

  The general objective of the research was to legally analyze the protected legal right violated in the criminal type of malicious accusation or denunciation. This research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. It is concluded that, legal good are the fundamental rights inherent to the human being that must be protected by the State, among these fundamental rights is the honor, which creates a useful condition for the development of the life of the individual and of the society, so that the malicious accusation or denunciation directly attempts against this very personal legal good, therefore, it is worthy of legal protection.
