El objetivo general de la investigación fue analizar jurídicamente los delitos de estafa a través de redes sociales en pandemia. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Se apoyó en la revisión documental-bibliográfica. Además, se empleó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó una encuesta a 62 fiscales y agentes investigadores de la provincia de Tungurahua, a fin de obtener información útil y confiable para el desarrollo del presente artículo científico. Se concluye que, las causas determinantes que han provocado el incremento de los delitos de estafa a través de las redes sociales en el periodo de confinamiento de la actual epidemia son: la dispersión geográfica de las víctimas, una dificultad notoria para identificar y localizar a los autores de tales hechos, esto ha dado paso a la posible impunidad de determinadas conductas.

The general objective of the research was to legally analyze the crimes of swindling through social networks in pandemic. The present research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was applied to 62 prosecutors and investigating agents of the province of Tungurahua, in order to obtain useful and reliable information for the development of this scientific article. It is concluded that, the determining causes that have led to the increase of fraud crimes through social networks in the period of confinement of the current epidemic are: the geographical dispersion of the victims, a notorious difficulty to identify and locate the perpetrators of such acts, this has given way to the possible impunity of certain behaviors.
