  El objetivo general de la investigación fue analizar jurídicamente el derecho al doble conforme como garantía básica del debido proceso. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Se apoyó en la revisión documental-bibliográfica. Además, se empleó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó un cuestionario dirigida a la población de jueces penales de la Provincia Bolívar y abogados en libre ejercicio profesional, se aplica a una muestra selectiva de 4 jueces penales y 100 abogados litigantes. Se concluye que, El derecho al doble conforme debe ser entendido de manera clara que es un derecho reconocido de manera exclusiva para la persona procesada que apele o impugne la sentencia condenatoria emitida por primera vez por parte del tribunal de apelación o de casación

  The general objective of the research was to legally analyze the right to double compliance as a basic guarantee of due process. This research used the quantitative method, which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A questionnaire was applied to the population of criminal judges of the Bolivar Province and lawyers in free professional practice, applied to a selective sample of 4 criminal judges and 100 trial lawyers. It is concluded that the right to double jeopardy must be clearly understood as a right recognized exclusively for the defendant who appeals or challenges the conviction issued for the first time by the court of appeal or cassation.
