    El objetivo general de la investigación fue analizar jurídicamente la despenalización del aborto por malformaciones congénitas incompatibles con la vida. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Se apoyó en la revisión documental-bibliográfica. Además, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. En conclusión, debido al análisis de los dictámenes e instrumentos internacionales de derechos humanos, la constitución, el Código Orgánico Integral Penal, la realidad jurídica y social alrededor del tema del aborto, las afectaciones psicológicas de las mujeres gestantes y la invisibilización que el Estado ecuatoriano ha realizado sobre los fetos y bebés con este tipo de malformaciones, es posible y es urgente despenalizar el aborto por malformaciones congénitas.

    The general objective of the research was to legally analyze the decriminalization of abortion for congenital malformations incompatible with life. The present research used the quantitative method which produces descriptive data, originating from data collection. It was supported by the documentary-bibliographic review. In addition, the inductive-deductive method was applied. The analytical-synthetic method was also used. In conclusion, due to the analysis of the opinions and international human rights instruments, the constitution, the Organic Integral Penal Code, the legal and social reality surrounding the issue of abortion, the psychological effects on pregnant women and the invisibility that the Ecuadorian State has made on fetuses and babies with this type of malformations, it is possible and urgent to decriminalize abortion for congenital malformations.
