Resumen de El influjo psíquico como instrumento directo para la autoría mediata en el delito de cohecho

  El objetivo general de la investigación fue analizar jurídicamente el influjo psíquico como instrumento directo para la autoría mediata en el delito de cohecho. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Conjuntamente, se aplicó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Además, se realizó un cuestionario a 3 fiscales, 3 jueces de Garantías Penales y 3 académicos de Pichincha. Se concluye que, el influjo psíquico actúa como un instrumento directo para la autoría mediata en el delito de cohecho, en la actualidad esta influencia dada por razones de poder, jerarquía o abuso de poder ha generado el nacimiento de este nuevo delito que no se encuentra tipificado de manera taxativa en la normativa penal ecuatoriana.

  The general objective of the research was to legally analyze psychic influence as a direct instrument for perpetration-by-means in the crime of bribery. The present research used the quantitative method which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. Together, the inductive-deductive method was applied. The analytical-synthetic method was also used. In addition, a questionnaire was sent to 3 prosecutors, 3 judges of Criminal Guarantees and 3 academics of Pichincha. It is concluded that the psychic influence acts as a direct instrument for the perpetration-by-means in the crime of bribery, currently this influence given for reasons of power, hierarchy or abuse of power has generated the birth of this new crime that is not typified in an exhaustive manner in the Ecuadorian criminal law.
