Resumen de Vulneración del derecho a la verdad en el caso Guachalá Chimbo versus Ecuador

  El objetivo general de la investigación fue analizar jurídicamente la vulneración del derecho a la verdad en el caso Guachalá Chimbo versus Ecuador. Se desarrolló como método el enfoque cualitativo, además se utilizó varias fuentes bibliográficas a fin de conseguir información real y actualizada para poder alcanzar el objetivo planteado frente al problema jurídico en análisis. La técnica de investigación aplicada fue la entrevista, de cinco preguntas, combinándose las de tipo abiertas con las de tipo cerradas, aplicándose a expertos en materia constitucional y profesionales del derecho de libre ejercicio, de la provincia de Pastaza, para recabar información. Se concluye que, la autonomía del derecho a la verdad se debe apreciar como la facultad de acudir a la justicia para exigirlo en cualquier momento siendo clave para evitar impunidad, además de que el reconocimiento a la verdad busca restablecer la armonía tanto en la conciencia individual, colectiva, y orden jurídico.

  The general objective of the research was to legally analyze the violation of the right to truth in the Guachalá Chimbo versus Ecuador case. The qualitative approach was developed as a method, and several bibliographic sources were used in order to obtain real and updated information to achieve the objective of the legal problem under analysis. The research technique applied was the interview, with five questions, combining open and closed questions, applied to experts in constitutional matters and free practice law professionals of the province of Pastaza, in order to gather information. It is concluded that the autonomy of the right to truth should be appreciated as the power to go to justice to demand it at any time being key to avoid impunity, besides the fact that the recognition of truth seeks to restore harmony both in the individual and collective conscience, and legal order.
