En este estudio se aborda la disputa referida en la colección del glosador Hugolinus (s. xiii), sobre la admisión del derecho de regreso en favor del tercero que gestionó útilmente un negocio ajeno, pero en contra de la prohibición del dominus negotii. Destaca la visión de Martinus Gosiae, dirigida a restablecer la aequitas patrimonial a través de la concesión de una actio negotiorum gestorum (utilis).

This study analyses the dispute referred to in the collection of the commentator Hugolinus (13th century), about the admission of the right of return in favor of a third party who usefully managed a foreign business, but acting against the prohibition of the dominus negotii. The vision of Martinus Gosiae stands out, aimed at restoring the patrimonial aequitas through the granting of an actio negotiorum gestorum (utilis).
