La eficacia del sistema interno de información o denuncia, que las empresas están obligadas a implantar tras la Ley 2/2023, estará condicionada a que ofrezca confianza y protección a las personas informantes (trabajadoras y asimiladas). En el contexto de una global valoración positiva de la Ley, en el presente trabajo se realizan una serie de observaciones críticas en relación con el plazo fijado para el cumplimiento de esta obligación, la falta de atención prestada a la necesaria estrategia sobre integridad de la organización y la falta de regulación e, incluso, de referencia expresa a las exigencias de formación, en esta materia, del personal de la empresa y en todo caso del adscrito al Sistema interno. Además, se analiza la relación entre este Sistema de información y los canales de denuncias previstos por el art. 31 bis del Código Penal, así como los creados por los protocolos anti-acoso. Finalmente, también se destacan contradicciones normativas en la regulación del sistema interno en el grupo de sociedades (art. 11 y art. 10) y en relación con la gestión del sistema por tercero externo (art. 6.1 y art. 12.)
The effectiveness of the internal reporting or whistleblowing system, which companies are obliged to implement after Law 2/2023, will be conditioned by the fact that they offer trust and protection to whistleblowers (workers and similar). In the context of an overall positive assessment of the Law, this paper makes a series of critical observations in relation to the deadline set for compliance with this obligation, the lack of attention paid to the necessary strategy on organizational integrity and the lack of regulation and even of express reference to the training requirements in this area for company personnel and, in any case, for personnel assigned to the internal system. In addition, the relationship between this information system and the reporting channels provided for by art. 31 bis of the Criminal Code, as well as those created by the anti-harassment protocols, is analyzed. Finally, it also highlights normative contradictions in the regulation of the internal system in the group of companies (art. 11 and art. 10) and in relation to the management of the system by an external third party (art. 6.1 and art. 12).
