    The contribution aims to encourage reflection and dialogue regarding the very recent introduction, with Law 22 January 2024, n. 6, of a new cumulative double track regarding the protection of cultural and landscape heritage. The first reading analysis conducted here follows two directions: (i) a rapid reconstruction of the current face of ne bis in idem, European and Italian; (ii) an exegetical-systematic analysis of the art. 1, co. 7, L. 22 January 2024, n. 6 conducted in parallel with the hermeneutic acquisitions formed on the art. 187-terdecies TUF which represents the structural model. The argumentative itinerary will therefore allow the new double track to be subjected to the close connection test and thus arrive at some first critical considerations on the legislative product

    Il contributo vuole sollecitare la riflessione e il dialogo in ordine alla recentissima introduzione, con Legge 22 gennaio 2024, n. 6, di un nuovo doppio binario cumulativo in materia di tutela del patrimonio culturale e paesaggistico. L’analisi a prima lettura qui condotta si snoda lungo due direttrici: (i) una rapida ricostruzione dell’attuale volto del ne bis in idem, europeo e italiano; (ii) un’analisi esegeticosistematica dell’art. 1, co. 7, L. 22 gennaio 2024, n. 6 condotta in parallelo con le acquisizioni ermeneutiche formatesi sull’art. 187-terdecies TUF che ne rappresenta il modello strutturale. L’itinerario argomentativo permetterà dunque di sottoporre al test di close connection il nuovo doppio binario e di giungere così a talune prime considerazioni critiche sul prodotto legislativo.
