  Resumen El presente artículo analiza el delito de abuso sexual por sorpresa, incorporado al ordenamiento jurídico penal chileno el año 2019. Con dicho fin, se plantea la necesidad de interpretar el texto que lo describe sistemáticamente, considerando especialmente la regulación del abuso sexual, del estupro y de la violación en el Código Penal chileno. Gracias a ello, sería posible superar una interpretación desmedida del tipo penal, que lo identifique, sin más, como un delito residual respecto de otros delitos contra la indemnidad sexual.

  Abstract This article analyzes the crime of sexual abuse by surprise, incorporated into the Chilean criminal legal system in 2019. To this end, the need to interpret the text that describes it systematically arises, especially considering the regulation of sexual abuse and rape in the Chilean Penal Code. Thanks to this, it would be possible to overcome an excessive interpretation of the regulation, which identifies it, without further ado, as a residual crime with respect to other crimes against sexual indemnity.
