Resumen de El intrincado debate en el caso Semenya contra Suiza: el arbitraje internacional deportivo en el centro de la controversia

  La presente investigación, al amparo de la reciente sentencia emitida por el Tribunal Europeo de Derechos Humanos y en relación con una controversia surgida entre una atleta internacional y la propia Asociación Internacional de Federaciones de Atletismo, pretende analizar una serie de aspectos muy concretos en el ámbito del arbitraje internacional deportivo. Sobre este particular, cabe decir que el caso Semenya se centra en las implicaciones que tienen ciertas normativas al limitar la participación de atletas en competiciones femeninas. En 2019, una atleta desafió tales regulaciones ante el Tribunal de Arbitraje Deportivo (Lausana); posteriormente, la deportista recurrió ante el Tribunal Federal Suizo; y, finalmente, decidió acudir al Tribunal de Estrasburgo. En este sentido, se examinarán cuestiones tales como la creación del citado tribunal arbitral, la acción de nulidad de los laudos arbitrales emitidos por éste, así como el propio contenido de la resolución citada.

  This research, under the protection of the recent judgment issued by the European Court of Human Rights and in relation to a dispute arising between an international athlete and the International Association of Athletics Federations itself, aims to analyze a number of very specific aspects in the field of international sports arbitration. In this regard, it should be said that the Semenya case focuses on the implications of certain regulations limiting the participation of athletes in women's competitions. In 2019, an athlete challenged such regulations before the Court of Arbitration for Sport (Lausanne); subsequently, the athlete appealed before the Swiss Federal Tribunal; and, finally, she decided to go to the Strasbourg Court. In this regard, issues such as the creation of the Court of Arbitration, the action for annulment of the arbitration awards issued by the Court, as well as the content of the decision itself will be examined.
