    En este artículo se analiza el papel de los tribunales constitucionales durante los estados de emergencia desde una perspectiva comparada. El objetivo es comprender si, cómo y hasta qué punto estos órganos pueden ejercer un control efectivo sobre el poder ejecutivo, contribuyendo así a la protección contra el abuso de los poderes de emergencia. El ensayo estudia, en particular, la revisión por parte de los tribunales constitucionales de la declaración y prórroga del estado de emergencia, así como de las medidas de emergencia adoptadas por las autoridades estatales durante los periodos de crisis, centrándose en la pandemia COVID-19. El artículo sugiere que los tribunales constitucionales pueden representar un baluarte importante para la defensa de los principios del constitucionalismo en tiempos de emergencia

    This article examines the role of constitutional courts in times of emergency from a comparative perspective. In particular, it aims at understanding if, how and to what extent these bodies can place effective checks on the executive branch, thus contributing to protecting against the abuse of emergency powers. The article discusses the constitutional courts’ review of the declaration and extension of the state of emergency, as well as the review of the emergency measures adopted by state authorities during periods of crisis, with a focus on the COVID-19 pandemic. The article suggests that constitutional courts can represent an important bulwark for the defence of the principles of constitutionalism in times of emergency.
