Resumen de La Corte Constitucional colombiana y el derecho a la educación de la población desplazada

  En este trabajo se pretende reconstruir los tipos de argumentos empleados por la Corte Constitucional Colombiana para justificar sus decisiones cuando está en riesgo el Derecho a la educación en población desplazada, a partir de una concepción de estado social de derecho expuesta en la Constitución Política y la teoría de la argumentación jurídica. Después de reconstruir e interpretar los argumentos expuestos en seis sentencias sobre desplazamiento (1997 y 2004), se concluye que la Corte acudió a argumentos como: normatividad, dogmática jurídica, hecho externo, principios fundamentales, precedente, autoridad,teleológico-objetivo, verdad jurídica, transitivita, genético, comparativo, principios constitucionales que constituyen el marco axiológico e interpretativo de la Constitución Política, interpretación de la ley recurriendo al argumento genético, y las valoraciones fundadas en principios y derechos constitucionales

  This work seeks to reconstruct the type of arguments used by the Colombian Constitutional Court to justify its decisions when the right to education of displaced persons is at risk. This is based on the concept of a social right as an obligation of the State as it appears in the Political Constitution and in the theory of legal argument. After the reconstruction and interpretation of the arguments expressed in six rulings on displacement (1997 and 2004), the conclusion is reached that the Court reorts to arguments such as norms, legal dogma, external factors, fundame tal principles, precedent, authority, teleological-objective considerations, legal truth, genetics, transitivity, the comparative application of the law, constitutional principles which form the axiological and interpretative frame work of the Political Constitution, an interpretation of the law which resorts to a genetic line of argument, and assessments based on constitutional principles and rights.
