  En este estudio se trata de la función desempeñada por los Juzgados de Bienes de Difuntos en Indias, institución especial que asumía la tutela de los bienes dejados por los españoles fallecidos, sin herederos, en aquellos reinos, hasta su entrega a los legítimos sucesores. Como modelo de la instrucción y etapas de este proceso nos hemos basado en las resoluciones que las Audiencias de Manila, México, Casa de Contratación de Cádiz y Justicia Ordinaria del valle de Cabuérniga adoptaron respecto a la herencia intestada de Isidro Vélez (Ruente 1687-Manila 1739), capitán y alcalde mayor que fue de los distritos de Balayan y Taal en las islas Filipinas, a quien hemos enmarcado en su época pensando en que es el recurso más razonable para lograr una adecuada comprensión del tema.

  This study deals with the function performed by the Courts of Deceased Property Deceased in the Indies, a special institution that assumed the guardianship of the propperty left by the deceased Spaniards without heirs in those remote kingdoms, until their delivery to their legitimate successors. As a model of the instruction and stages of this process we haved based ourselves on the resolutions that the Courts of Manila, México, the Indies Contrating House of Cádiz and the Justice of the Cabuerniga Valley, adopted regarding intestate inheritance of Isidro Vélez (Ruente 1687-Manila 1739), captain and mayor who was from the districts of Balayan and Taal in the Philippine Islands, whom we have framed in his time as the most reasonable way to understand the subject.
