Resumen de Principio de Economía Procesal: Pensión Alimenticia & Régimen de Visitas

  El articulo que se presenta es respecto a la sustanciación de los juicios de alimentos en donde el juzgador solo se reserva en resolver sobre la pretensión de la parte actora siendo esta la fijación de la pensión alimenticia. Pero para una mayor eficacia y mínima intervención de la función judicial se debería efectivizar la economía procesal respecto al régimen de visitas y pensión de alimentos para una mejor convivencia con su hijo/a. Siendo así se incentiva a que el administrador de justicia regule en una sola audiencia, tutelando el interés superior del niño, una correcta tutela efectiva de los derechos y seguridad jurídica la unificación de estas dos figuras jurídicas. El objetivo del trabajo es analizar la respectiva aplicación del principio de economía procesal en la legislación ecuatoriana en el sistema procesal dirigido a las causas derivadas del derecho de familia. Para alcanzar este objetivo se desarrollará una investigación cualitativa de la revisión de documentos, análisis doctrinarios como jurídicos y análisis de repositos universitarios respecto al tema establecido. Entre los principales análisis se encuentran lo concerniente a: principio de economía procesal (concentración, saneamiento, celeridad) y la contextualización jurídica y doctrinaria de los preceptos como son: Pensión alimenticia & Régimen de visitas.

  The article that is presented is regarding the substantiation of food trials where the judge only reserves to resolve on the claim of the plaintiff, this being the fixing of alimony. But for greater efficiency and minimal intervention of the judicial function, the procedural economy should be made effective with respect to the visitation regime and alimony for a better coexistence with your child. This being the case, the administrator of justice is encouraged to regulate in a single hearing, protecting the best interests of the child and a correct effective protection of the rights and legal security, the unification of these two legal figures. The objective of the work is to analyze the respective application of the principle of procedural economy in the Ecuadorian legislation in the procedural system directed to the causes derived from family law. To achieve this objective, a qualitative investigation of the review of documents, doctrinal and legal analyzes and analysis of university deposits regarding the established topic will be developed. Among the main analyzes are the worrying: principle of procedural economy (concentration, sanitation, speed) and the legal and doctrinal contextualization of the precepts such as: Alimony & Visitation regime.
