Resumen de La real complejidad de la labor judicial en la audiencia preparatoria: reconociendo el rol articulador de las juezas y los jueces de familia

En materia de tribunales de familia, el papel de los jueces y juezas en la audiencia preparatoria ha sido poco estudiado, especialmente desde una perspectiva holística del mismo. El presente trabajo postula que los jueces y juezas de familia en el contexto de esta particular audiencia desarrollan un conjunto de actividades judiciales que buscan satisfacer una gran variedad intereses y objetivos, los que muchas veces se encuentran en tensión y debe ser resuelta por los jueces y juezas. Para lo anterior, los jueces y juezas deben echar mano a diversas herramientas y estrategias, pretendiendo dar a cada interés y finalidad el espacio que ameritan, identificándose así un rol articulador que no ha sido reconocido en nuestro medio. La identificación y caracterización de este rol, permite observar la real complejidad de la labor judicial en la audiencia preparatoria.

The role of the family judge in the context of the pretrial hearing has not received adequate attention, especially from a holistic standpoint. The following proposes that family judges in the specific context of the pretrial hearing need to develop a series of judicial activities that aim to satisfy a great variety of interest and goals, many of which are in tension, situation that needs to be resolved by the judges. To do this, they must resort to different tools and strategies, to provide each of them adequate space in their decision-making process and actions. It is possible to identify a balancing role, role that our scholarship has not identified so far. Its identification and characterization allow us to recognize the real complexity of the judicial role at the pretrial hearing.
