Resumen de Reparación integral en colombia: ¿una denegación de reparación?

  La reparación integral es uno de los principales derechos que tienen las víctimas cuando resultan afectadas por un hecho victimizante en medio de un conflicto armado, sin tener en cuenta su índole. En Colombia se ha presentado uno de los más sangrientos conflictos armados internos que ha generado un elevado número de víctimas. Entonces, por medio del método cualitativo con enfoque descriptivo se va a estudiar si la reparación integral en Colombia ha sido efectiva. Para tal fin, se realizará una aproximación al conflicto armado en Colombia. Para posteriormente, revisar el termino de reparación integral adoptado en el sistema Interamericano y aterrizarlo al caso colombiano. Los resultados demuestran que las víctimas que han sido reparadas y las que se espera reparar al 2026 no son las suficientes, lo cual se convertirá en una revictimización para la víctima enmarcada en una denegación de justicia, lo cual va en contra de sus derechos como sujeto de especial protección.

  Comprehensive reparation is one of the main rights that victims have when they are affected by a victimizing event in the midst of an armed conflict, regardless of its nature. Colombia has experienced one of the bloodiest internal armed conflicts that has generated a high number of victims. Therefore, by means of the qualitative method with a descriptive approach, we will study whether comprehensive reparation in Colombia has been effective. To this end, an approach to the armed conflict in Colombia will be made. Subsequently, the term comprehensive reparation adopted in the Inter-American system will be reviewed and grounded in the Colombian case. The results show that the victims who have been repaired and those who are expected to be repaired by 2026 are not enough, which will become a revictimization for the victim framed in a denial of justice, which goes against their rights as a subject of special protection
