La aprobación por silencio de los proyectos de reparcelación: limitaciones administrativas y registrales

    La resolución de la Dirección General de Seguridad Jurídica y Fe Pública de 4 de octubre de 2023 se ocupa de la inscripción de un proyecto de reparcelación aprobado por silencio conforme admite la legislación autonómica para rechazar que pueda tener lugar en base a la interpretación contraria realizada al respecto por el Tribunal Supremo por considerar que su reconocimiento supone la transferencia al particular solicitante de facultades relativas al servicio público, por los efectos neutralizadores que, pese al transcurso del plazo legalmente previsto, se desprenden de la oposición de la Administración a su reconocimiento cuando resulta contrario al planeamiento urbanístico y, en fin y como objeción estrictamente registral, por el impedimento que supone la inexistente acreditación administrativa, ya fuera expresa o presunta, de la aprobación.

    The resolution of the Directorate General for Legal Security and Public Faith of 4 October 2023 deals with the registration of a reparcelling project approved by silence to reject that it can take place in those cases in which, despite the expiry of the legally established period, the Administration opposes its recognition on the grounds that it is contrary to the planning. To this is added the interpretation of the Supreme Court against the positive sense of silence in relation to acts of management on the grounds that its recognition implies the transfer to the individual applicant of powers relating to the public service and, on the other hand, the obstacles to ensure its full operability, especially in the registry order.
