Resumen de Mediación en Conflictos Relacionados con Derechos de la Niñez y la Adolescencia: : preservación de la Relación Familiar y Colaboración con la Labor Judicial

  Este trabajo trata sobre conflictos concernientes a la Niñez y Adolescencia, que por su connotación personal y emocional, pues los litigantes son o han sido familia, se ve la necesidad de buscar afectar lo menos posible a niños y/o adolescentes involucrados. Para ello se consideró un método autocompositivo como es la mediación, a fin de preservar la relación entre las partes para llegar a una solución eficiente. Como objetivo se estableció:la aplicación de un mecanismo de resolución de conflictos colaborativo como más eficiente para resolver conflictos derivados del vínculo familiar en comparación a un mecanismo adversarial. Este propósito se consiguió a partir de la revisión bibliográfica y legal, también a través de entrevistas y datos estadísticos de la Oficina de Mediación del Poder Judicial y del Juzgado de 1ra Instancia de la Niñez y Adolescencia, 1er Turno, Secretaría Nº 1 de Encarnación. La investigación demuestra que la aplicación de la mediación es preferente a fin de preservar la relación en los tipos de casos mencionados, la cantidad de estos finalizados por este medio demuestran su eficiencia permitiendo que el Juez pueda entender exclusivamente en casos que por su complejidad necesitan una decisión judicial expresa.

  This work deals with conflicts concerning Children and Adolescents, which due to their personal and emotional connotations, because the litigants are or have been family, we see the need to seek to affect children and / or adolescents involved as little as possible. To this end, a self-supporting method was considered, such as mediation, in order to preserve the relationship between the parties in order to reach an efficient solution. The objective was established: the application of a collaborative conflict resolution mechanism as more efficient to resolve conflicts derived from the family bond in comparison to an adversarial mechanism. This purpose was obtained from the bibliographic and legal review, also through interviews and statistical data from the Office of Mediation of the Judiciary and the Court of the 1st Instance of Childhood and Adolescence, 1st Turn, Secretariat No.1 of Encarnación. Research shows that the application of mediation is preferred in order to preserve the relationship in the types of cases mentioned, the amount of these completed by this means demonstrate their efficiency allowing the Judge to understand exclusively in cases that due to their complexity need a express judicial decision.
