    En el presente estudio se abordará un estudio de la política migratoria norteamericana en relación con el trato a los menores y sus polémicas recientes decisiones.Se tratarán cuestiones como el limbo jurídico en el que se encuentran millones de adolescentes, los denominados “dreamers”, el escandaloso tratamiento de los menores anclados, conocidos como “anchor babies” y, para terminar, la reciente decisión del presidente Trump de separar y enjaular a los menores inmigrantes en la frontera, así como sus retrasos en su devolución, tras la correspondiente sentencia judicial. Para ello, se realizará un análisis, tanto desde un punto de vista político, de las decisiones gubernamentales adoptadas, como judicial, de la respuesta que las mismas han tenido por los tribunales tanto a nivel nacional, como su repercusión en el ámbito internacional, en especial por Naciones Unidas. Todo ello a luz de los Derechos Humanos y el interés superior del menor, subrayando el hecho de que Estados Unidos es el único país del mundo que no ha ratificado la Convención de Derechos del Niño, la más apoyada de la historia con 196 ratificaciones.

    In this study we will analyze North American migratory politics in relation with migrant children and the Federal Governments recent controversial decisions. It will focus on several questions like the legal limbo in which they find one million teenagers, the designated dreamers. The scandalous treatment of the minors known as “anchor babies”, children of parents who have been deported and who have North American nationality and it will end with the recent decision of President Trump, this spring, to separate and cage immigrant minors on the Southern border, as well as their delays in their return after the corresponding judicial sentence. Due to these types of questions we will do a multidisciplinary analysis from a political perspective, focusing on governmental decisions, from judicial reviews of the sentences pronounced by different Courts. As well as its repercussion in the international field. Finally, the study will conclude, remarking on the impact of this child immigration policy in front of Human Rights and the best interests of the child considering the United States is the only country in the world that has not yet ratified the Convention of Rights of the Child, the most supported in history with ratifications.
