  Este artículo se refiere a la primacía constitucional e internacional en la tutela de los derechos fundamentales (humanos) del individuo. Alude a los medios instituidos para proveer a dicha tutela, tanto en el plano interno como en el internacional o supranacional. Por ello invoca el juicio de amparo, el régimen de acciones de inconstitucionalidad y las controversias constitucionales, en los términos en que las ha regulado la reforma constitucional de 1994-1995. Se pone especial atención en los medios internacionales de control y en su desarrollo doctrinal y jurisprudencial, principalmente a través de la doctrina adoptada por la Corte Interamericana de Derechos Humanos, que ha incorporado novedades relevantes sobre el control de convencionalidad. El artículo analiza, entre otros extremos, la naturaleza de esta figura de control, que tiene —o debe tener, según el autor— un carácter jurisdiccional. Por ello sostiene la idea de que el control se halla en manos de autoridades dotadas de atribuciones jurisdiccionales.

  This article focuses on constitutional and international supremacy in the protection of the fundamental (human) rights of the person. It discusses the means provided for such protection, both domestically and internationally or even supranationally. It therefore invokes the amparo trial, the trial of unconstitutionality scheme and constitutional controversies under the terms set forth in the 1994-1995 constitutional reform. Particular attention is paid to international means of control and its evolution by means of legal scholarship and case-law, particularly those adopted by the Inter-American Court of Human Rights, which has incorporated important innovations on conventionality control. The article analyzes, inter alia, the nature of this type of control, which, in the author’s opinion, is —or should be— of a jurisdictional nature and, based on this reason, upholds the idea that control is in the hands of the authorities vested with jurisdictional powers.
