Resumen de Seguridad jurídica como derecho constitucional en la justicia indígena y la justicia ordinaria

  El objetivo general de la investigación fue analizar jurídicamente la seguridad jurídica como derecho constitucional en la justicia indígena y la justicia ordinaria. La presente investigación utilizó el método cuantitativo el cual produce datos descriptivos, que se originan por la recolección de datos. Apoyado en la revisión documental-bibliográfica. Además, se empleó el método inductivo-deductivo. Se planteó además el método analítico-sintético. Se aplicó una encuesta, con una muestra de 10 miembros de la comunidad indígena. Se concluye que, de la correcta aplicación de la justicia ordinaria y la justicia indígena se puede concluir que tienen sus diferentes métodos, pero con la misma finalidad: el orden y la seguridad jurídica; de manera que las decisiones tomadas tanto en una jurisdicción como en la otra deben estar ajustadas a los principios básicos del derecho, garantizar los derechos humanos y aplicar la verdadera justicia.

  The general objective of the research was to carry out a legal analysis of legal security as a constitutional right in indigenous and ordinary justice. This research used the quantitative method, which produces descriptive data, originating from data collection. Supported by the documentary-bibliographic review. In addition, the inductive-deductive method was used. The analytical-synthetic method was also used. A survey was carried out with a sample of 10 members of the indigenous community. It is concluded that, from the correct application of ordinary justice and indigenous justice, it can be concluded that they have their different methods, but with the same purpose: order and legal security; so that the decisions taken both in one jurisdiction and in the other must be adjusted to the basic principles of law, guarantee human rights and apply true justice.
