Las ONG's, el lavado de dinero y el financiamiento del terrorismo

    El desarrollo de las regulaciones antilavado de dinero y financiamiento al terrorismo dirigidas a organizaciones sin fines de lucro como producto de instrumentos internacionales cuyo objetivo es combatir la corrupción y el tráfico de estupefacientes, así como de países poderosos que conforman el G7 del cual surge la creación del Grupo de Acción Financiera Internacional (GAFI) entidad que a su vez desarrolla los estándares internacionales que buscan erradicar tales delitos ha conllevado a que en El Salvador surjan regulaciones como parte de compromisos de Estado para implementar medidas que buscan erradicar prácticas que permitan cometer el delito de lavado de dinero y de activos y el financiamiento al terrorismo.

    En tal sentido, es recomendable hacer efectivas algunas obligaciones para que El Salvador, de acuerdo a los referidos estándares GAFI, pueda darles un efectivo cumplimiento, partiendo de una de las recomendaciones del organismo internacional, como es la realización de una Evaluación Nacional de Riesgos. Asimismo, se hacen breves reflexiones sobre las implicaciones de las regulaciones antilavado hacia las organizaciones sin fines de lucro como parte de las entidades sujetas a aquellas y que estas, a su vez no afecten el derecho humano a la libertad de asociación. Con la implementación del nuevo Instructivo de la Unidad de Investigación financiera en contraste a la Recomendación 8 y su Nota Interpretativa de GAFI se realizan comentarios sobre las posibles repercusiones que las nuevas obligaciones puedan acarrear a las organizaciones con baja capacidad humana y financiera puedan cumplir, ante ello, se insiste constantemente en la realización de una efectiva Evaluación Nacional de Riesgos que permita dirigir regulaciones específicas a ONGs con ciertas características y no al universo de estas.

    The development of anti-money laundering and anti-terrorist financing regulations aimed at non-profit organizations as a result of international instruments aimed at combating corruption and drug trafficking, as well as powerful countries that make up the G7 from which the Financial Action Task Force (FATF) was created, entity that in turn develops the international standards that seek to eradicate such crimes has led to the creation of regulations in El Salvador as part of the State’s commitments to implement measures aimed at eradicating practices that allow the commission of money laundering and financing of terrorism. In this sense, it is advisable to enforce some obligations so that El Salvador, in accordance with the FATF standards, can effectively comply with them, based on one of the recommendations of the international organization, such as conducting a National Risk Assessment. In addition, brief reflections are made on the implications of anti-money laundering regulations for non-profit organizations as part of the entities subject to them and that these, in turn, do not affect the human right to freedom of association.With the implementation of the new Instructions of the Financial Investigation Unit in contrast to Recommendation 8 and its FATF Interpretative Note, comments are made on the possible repercussions that the new obligations may have for organizations with low human and financial capacity to comply with the new requirements, in view of this, there is constant insistence on carrying out an effective National Risk Assessment that would allow specific regulations to be directed to NGOs with certain characteristics and not to the universe of NGOs.
