La figura del defensor judicial, actuando en representación del menor, asume un papel fundamental en la protección de sus derechos en situaciones específicas o temporales, sustituyendo al representante legal. Su designación, aunque puntual, reviste de importancia para garantizar la salvaguarda de los intereses del menor frente a conflictos de interés. La configuración actual del defensor judicial ha experimentado notables modificaciones con la promulgación de la Ley 8/2021, cuyas implicaciones son objeto de análisis en el presente estudio.

The figure of the legal guardian, acting on behalf of the minor, assumes a pivotal role in safeguarding their rights in specific or temporary situations, effectively substituting the legal representative. Although their appointment may be temporary, it holds paramount importance in ensuring the safeguarding of the minor’s interests against conflicts of interest. The current structure of the legal guardian has undergone notable modifications with the enactment of Law 8/2021, the implications of which are subject to analysis in this study.
