Resumen de La vivienda como derecho fundamental: Compromisos internacionales más allá del principio rector

El presente trabajo tiene como objetivo principal constatar que, pese a que el derecho a la vivienda se haya consagrado en nuestra Constitución como un Principio rector de la política social y económica, las obligaciones internacionales que posee España, tras la ratificación de la Carta Social Europea revisada y del Pacto Internacional de Derechos Económicos, Sociales y Culturales y de la asunción de sus sistemas de control, dan un nuevo sentido al derecho establecido en el artículo 47 de la Constitución española, dotándolo de mayor fuerza vinculante y, sobre todo, de mayores garantías. Este análisis del derecho fundamental a la vivienda no puede desvincularse del principio de indivisibilidad de los derechos humanos y del respeto de la dignidad de la persona, ejes centrales del estudio. The main objective of this paper is to verify that, despite the fact that the right to housing has been enshrined in our Constitution as a governing principle of the Economic and Social Policy, the international obligations that Spain, after the ratification of the revised European Social Charter and the International Covenant on Economic, Social and Cultural Rights and the assumption of their control systems, has given a new meaning to the right established in Article 47 of the Spanish Constitution, giving it greater binding force and, above all, greater guarantees. This analysis of the fundamental right to housing cannot be separated from the principle of the indivisibility of human rights and the respect for the human dignity, which are the central axes of the study.
