Resumen de Inteligencia Artificial, decisiones administrativas discrecionales totalmente automatizadas y alcance del control judicial: ¿indiferencia, insuficiencia o deferencia?

El objeto de este artículo se centra en las posibilidades y límites de la adopción totalmente automatizada de decisiones administrativas discrecionales, el papel de la supervisión humana y el alcance e intensidad del control judicial de dichas decisiones. El estudio se detiene brevemente en la explicación de algunos conceptos esenciales vinculados a la IA para clarificar su uso en este análisis. Entre ellos, se realiza un breve análisis del concepto tradicional de discrecionalidad administrativa en España, poniendo de relieve su falta de profundidad y la necesidad de repensarlo a la luz de la buena administración. A partir de aquí, se abordan cuáles son los límites jurídicos de la IA y cómo deberían conducir a evitar su uso para la automatización total del ejercicio de potestades discrecionales, en el estado actual de la técnica. Esa limitación conduce a lo que se denomina una reserva de humanidad, que se desarrolla a continuación. Finaliza el análisis exponiendo la adaptación de las técnicas de control judicial al ejercicio de potestades administrativas con IA, los posibles problemas de indiferencia e insuficiencia que puede tener dicho control judicial y el nivel de intensidad de control judicial que debiera desarrollarse.

The focus of this article is on the possibilities and limits of fully automated discretionary administrative decision-making, the role of human supervision and the scope and intensity of judicial control of such decisions. The study stops briefly to explain some essential concepts linked to AI in order to clarify their use in this analysis. Among them, a brief analysis is made of the tra-ditional concept of administrative discretion in Spain, highlighting its lack of depth and the need to rethink it in the light of good administration. From here, the legal limits of AI are addressed and how they should lead to avoid its use for the total automation of the exercise of discretio-nary powers, in the current state of the art. This limitation leads to what is called a reservation of humanity, which is discussed below. The analysis ends with the adaptation of judicial control techniques to the exercise of administrative powers with AI, the possible problems of indifference and insufficiency that such judicial control may have, and the level of intensity of judicial control that should be developed.
