Resumen de Algoritmización de la justicia penal: entre fé, confianza y garantías procesales

En el presente trabajo, analizaremos como la digitalización de la Administración de Justicia y el fenómeno de la justicia predictiva, sumados a la fe que el fenómeno de las redes sociales e internet han depositado en las nuevas tecnologías, ponen en jaque la idea de proceso penal que hasta ahora hemos conocido. Se cuestiona, en este sentido, si la fe ciega en las nuevas tecnologías puede abrir paso a un sistema penal más eficaz o si, por otro lado, constituye una amenaza al extenso sistema de garantías procesales desarrollado a lo largo de los últimos siglos.

In this paper, we will analyze how the digitization of the Justice Administration and the phenomenon of predictive justice, coupled with the faith that social media and the internet have instilled in new technologies, challenge the notion of criminal procedure as we have known it thus far. It questions whether blind faith in new technologies can pave the way for a more effective penal system or whether, on the other hand, it constitutes a threat to the extensive system of procedural guarantees developed over the past centuries
