    Se analiza, en primer lugar y con carácter general, el significado de la condición de “víctima” conforme al Convenio Europeo de Derechos Humanos. Se examinan las vulneraciones del precitado convenio conectadas con el cambio climático que podrían sustentar la legitimación del demandante. Finalmente, se estudian los requisitos específicos que el Tribunal Europeo de Derechos Humanos exige para poder ostentar la condición de víctima cuando las violaciones del convenio que se arguyen traen causa de incumplimientos del Estado con respecto a sus obligaciones frente al cambio climático.

    First, and in general, the meaning of the status of “victim” under the European Convention on Human Rights is analyzed. It examines the breaches of the aforementioned convention connected with climate change that could support the claimant’s standing. Finally, the specific requirements that the European Court of Human Rights requires to be able to hold the status of victim when the alleged violations of the convention are caused by non-compliance by the State of its obligations in relation to climate change are studied.
