El mejoramiento del nivel de vida de los habitantes de laSubregión es un bien jurídico a ser tutelado, y se relaciona conel desarrollo harmónico de los Países Miembros. Toda normaandina deber ser elaborada, interpretada y aplicadaprotegiendo los derechos humanos. El debido proceso es elderecho fundamental procesal por excelencia. El sistema de laComunidad Andina está inspirado en los derechosfundamentales de igualdad y no discriminación, que tambiéntienen sus límites al protegerse bienes superiores como la viday salud de las personas, el medio ambiente sano, y el cuidadode los derechos colectivos de seguridad y salubridad pública,en la medida de la necesidad de protección del bien común.Ello también sustenta el que, al existir una ponderación entrediversos derechos fundamentales, prevalecen aquellos quebenefician al bienestar comunitario.

The improvement of the standard of living of the inhabitantsof the Subregion is a legal asset to be protected, and it is relatedto the harmonious development of the Member States. AllAndean regulations must be developed, interpreted andapplied protecting human rights. Due process is thefundamental procedural right for excellence. The AndeanCommunity system is inspired by the fundamental right ofequity and non-discrimination, which also have its limits whenprotecting superior rights as life and health of people, a healthyenvironment and the care of collective rights of public safety and health, to the extent of the need to protect collectivewelfare. This also supports the fact that, when there is abalance between various fundamental rights, those that benefitcollective welfare prevail.
