Tras dejar constancia que la función arbitral atribuida alTribunal de Justicia y a la Secretaría General de la ComunidadAndina no ha sido reglamentada, el autor destaca la necesidadde una reforma estatutaria o de un cambio jurisprudencial quegarantice la protección de los derechos de los particulares quehan celebrado contratos con órganos e institucionescomunitarias. Además, pone de relieve las limitaciones paraque los particulares se sometan al arbitraje previsto en elTratado de Creación del Tribunal de Justicia en controversiasderivadas de contratos de carácter privado regidos por elordenamiento jurídico de la Comunidad Andina.
After noting that the arbitration function attributed to the Courtof Justice and the General Secretariat of the AndeanCommunity has not been regulated, the author stresses theneed for a statutory reform or a change in case law to ensurethe protection of the rights of individuals who have contractedwith Andean institutions. In addition, the article highlights thelimitations for individuals to submit to arbitration provided forin the Treaty of Creation of the Court of Justice in disputesarising from private contracts governed by the legal system ofthe Andean Community.
