Este artículo explora la evolución del derecho de marcas en laComunidad Andina, centrándose en la historia jurisprudencialy la evolución del concepto de distintividad. En un análisisdetallado, se examinan las interpretaciones prejudiciales quedelinean la comprensión de la distintividad, incluida ladistintividad intrínseca y extrínseca. Se investigan los factoresque han influido en la construcción del concepto dedistintividad de las marcas, desde influencias legislativas hastala posición de los magistrados. Finalmente, el artículo culminacon una visión del concepto moderno de distintividad,destacando cómo la jurisprudencia andina ha depurado estanoción clave para adaptarse a los desafíos actuales del derechode marcas. El artículo no solo otorga luces sobre el trayectojurídico de las marcas en la Comunidad Andina, sino quetambién ofrece perspectivas sobre la importancia de ladistintividad en una materia tan dinámica como la PropiedadIntelectual.

This article explores the evolution of trademark law in theAndean Community, focusing on the history of jurisprudenceand the evolution of the concept of distinctiveness. Through adetailed analysis, we examine the prejudicial interpretationsthat have shaped the understanding of distinctiveness,including intrinsic and extrinsic distinctiveness. The factors that have influenced the construction of the concept ofdistinctiveness of trademarks are investigated, from legislativeinfluences to the position of magistrates. Finally, the articleculminates with an overview of the modern concept ofdistinctiveness, highlighting how Andean jurisprudence hasrefined this key notion to adapt to the current challenges oftrademark law. This study not only sheds light on the legaltrajectory of trademarks in the Andean Community, but alsooffers perspectives on the importance of distinctiveness in thedynamic field of intellectual property.
