El Tribunal de Justicia de la Comunidad Andina haevolucionado al punto en el que sus decisiones en el marco deInterpretaciones Prejudiciales pueden ser permeadas no solopor la opinión de organismos o instituciones nacionales ointernacionales, sino también por los puntos de vista de lospartes formulados in abstracto, sin que ello impliquecomprometer la imparcialidad de la corte andina. Estoconstituye un desarrollo que permite comprender el motivo porel cual las interpretaciones prejudiciales son relevantes para lasautoridades nacionales y la evolución del entendimiento de lasregulaciones aplicables.

The Andean Community Court of Justice has evolved to thepoint in which its Preliminary Rulings can be permeated notonly by the opinions of international or national organizationsand institutes, but also by the parties, without compromisingin any way the impartiality of the Court and allowing theparties to present their views, even in an abstract response tothe questions of the Court. This is a development that helps toacknowledge why Preliminary Rulings are relevant for theauthorities and the evolution of the understanding of theapplicable regulations.
