En celebración del cuadragésimo quinto aniversario decreación del Tribunal de Justicia de la Comunidad Andina(TJCA), este artículo presenta una perspectiva de las laboresdel TJCA a desde la óptica del Presidente de otra cortesubregional, la Corte de Justicia del Caribe (Caribbean Courtof Justice – CCJ). Al igual que la CCJ, el TJCA es una corteque sirve a una pequeña comunidad de Estados dentro de unaregión conformada por naciones «en vías de desarrollo» o «deltercer mundo». El establecimiento de ambas cortes demuestrala determinación y resiliencia de los pueblos de las respectivasregiones para avanzar en su camino hacia laautodeterminación, la resolución propia de sus disputas, elfomento de la integración regional y económica, la promocióndel estado del derecho y la creación de un corpus dejurisprudencia sobre el derecho comunitario que guía a losEstados y a los particulares de la Comunidad.

In celebration of the 45th anniversary of the Court of Justiceof the Andean Community (Tribunal de Justicia de laComunidad Andina – TJCA), this article presents aperspective of the TJCA through the lens of the President ofanother sub-regional court, the Caribbean Court of Justice(CCJ). Like the CCJ, the TJCA is a court serving a smallcommunity of States within a region, viewed as ‘developing’ or ‘third world’ States. The establishment of both courts showsthe determination and resilience of the people of theirrespective region to advance their drive for self-determination,arbitrate their own disputes, foster regional and economicintegration, uphold the rule of law and create a body ofCommunity law jurisprudence that guides States andindividuals of the Community.
