El presente trabajo tiene como objetivo hacer una revisión sistemática de la nueva ley de regulación de la eutanasia (2021) en España y analizar el siguiente problema: la ausencia de un fundamento que dé legitimidad ética-médica propiamente dicha a la Ley, dado que las motivaciones y justificaciones que se ofrecen al principio del documento sobre la necesidad de que exista una Ley de eutanasia, así como las razones que explica para haber sido propuesta y aprobada, tienen como punto de partida una cosmovisión moral que no tiene un apoyo científico-médico. Me centraré en como las neurociencias clínicas entienden hoy el recurso al suicidio y por qué la ley de eutanasia no hace justicia a los actuales conocimientos científicos sobre la ideación suicida.
This paper aims to make a systematic review of the new Spaniard Euthanasia Act (2021) and to analyse the following problem: the absence of a foundation that gives a proper ethical-medical legitimacy to the Act, given that the motivations and justifications offered at the beginning of the document on the need for a euthanasia Act, as well as the reasons that explain to be proposed and approved, have as starting point a moral worldview that does not have scientific-medical support. I will focus on how the clinical neurosciences understand the resort to suicide and why the Euthanasia Law does not do justice to the current scientific knowledge on suicidal ideation.
