La historia clínica como instrumento médico-legal probatorio

    Introducción: La historia clínica es el documento médico-legal donde queda registrada la evidencia del trabajo realizado con los pacientes por parte del personal de la salud. La principal utilidad de este documento es para la labor asistencial, no obstante, también tiene valor para la docencia e investigación.Objetivo: Sintetizar la literatura disponible sobre la historia clínica como instrumento médico-legal probatorio.Material y Métodos: Se realizó una revisión sistemática en las bases de datos Dimensions, Medline, SciELO, Lilacs, en el sitio OMS IRIS y en el buscador google académico. Se utilizaron diferentes descriptores en ciencias de la salud y palabras clave para la estrategia de búsqueda. Se estudiaron las variables: Co-ocurrencia de Palabras Clave; temática abordada en los artículos; elementos jurídicos sobre confidencialidad y secreto profesional en América Latina.Resultados: Hubo un predominio del idioma inglés con 17 artículos para un 42,5 %, seguido por artículos en lenguaje español con 14, representando el 35 %. La fuente de información que más registros aportó fue Dimensions con 19 registros para un 49,5 %. Los países más productivos fueron Indonesia, Estados Unidos de América y Ecuador con 11, 4 y 3 estudios respectivamente. Según la clasificación temática los más frecuentes fueron la gestión electrónica o documental y el valor probatorio de la historia clínica.Conclusiones: Con el auge de la telemedicina, el uso de la historia clínica electrónica y servicios médicos en línea crece la vulnerabilidad de los pacientes y usuarios, por lo que urge tener un marco legal regulatorio sólido que conceda a la historia clínica el verdadero valor para el personal de la salud, administrativo, instituciones y en especial a los pacientes.

    Introduction: The clinical history is the medical-legal document where the evidence of the work carried out with patients by health personnel is recorded. The main use of this document is for healthcare work, however, it also has value for teaching and research.Objective: To synthesize the available literature on clinical history as a medical-legal evidentiary instrument.Material and Methods: A systematic review was carried out in the databases Dimensions, Medline, SciELO, Lilacs, on the WHO IRIS site and on the Google academic search engine. Different descriptors in health sciences and keywords were used for the search strategy. The following variables were studied: Co-occurrence of Keywords; topic addressed in the articles; legal elements on confidentiality, and professional secrecy in Latin America.Results: There was a predominance of the English language with 17 articles for 42.5%, followed by articles in the Spanish language with 14, representing 35%. The information source that provided the most records was Dimensions with 19 records for 49.5%. The most productive countries were Indonesia, the United States of America and Ecuador (11, 4 and 3 studies, respectively). According to the thematic classification, the most frequent were electronic or documentary management and the evidentiary value of the clinical history.Conclusions: With the rise of telemedicine, the use of electronic medical records and online medical services increases the vulnerability of patients and users, which is why it is urgent to have a solid legal regulatory framework that grants medical records the true value for health personnel, administrative personnel, institutions and especially patients.
