Resumen de La limitada regulación legal y del aprovechamiento como fuente de financiamiento del capital social cooperativo en Cuba: propuestas para su perfección

Las cooperativas no constituyen un fenómeno de reciente surgimiento en Cuba, sin embargo hasta el 2012 estas se limitaron solo al contexto agropecuario. Posterior a ese año se aprueba el marco legal básico que permite constituir cooperativas de objeto social distinto al agrario. Pese a esa extensión, consecuencia de la divergencia del marco legislativo nacional para una u otras cooperativas y debido a la no existencia de una Ley General de Cooperativas, el orden legal en esta materia en Cuba posee notables incongruencias que trasciende a las instituciones jurídicas que lo conforman. Este es el caso de la figura del capital social cooperativo, la que no se incluye con carácter generalizador en la legislación cooperativa cubana, además de contar con una exigua regulación que trasciende a sus presupuestos, a la de las aportaciones que la conforman y a su utilidad práctica.

Cooperatives are not a phenomenon of recent emergence in Cuba, however until 2012 they were limited only to the agricultural context. After that year, the basic legal framework that allows for the establishment of cooperatives with a social purpose other than agricultural is approved. Despite this extension, a consequence of the divergence of the national legislative framework for one or the other cooperatives and due to the non-existence of a General Law of Cooperatives, the legal order in this matter in Cuba has notable inconsistencies that transcend the legal institutions that govern it. make up. This is the case of the figure of cooperative social capital, which is not generally included in Cuban cooperative legislation, in addition to having a meager regulation that transcends its budgets, the contributions that make it up and its usefulness practice.
