  Las medidas de investigación corporal son «medidas restrictivas de derechos fundamentales que, en concreto, suponen injerencias sobre el cuerpo de las personas» (1) . Tradicionalmente, la jurisprudencia constitucional ha distinguido entre las inspecciones y las intervenciones corporales. Dada la heterogeneidad de supuestos, el presente trabajo se centrará en las medidas de investigación que tienen por objeto el cuerpo humano en el ámbito del Derecho Procesal Penal. De un lado, nos centraremos en la normativa actual y la proyección futura de su regulación, con referencia al nuevo Anteproyecto de Ley de Enjuiciamiento criminal del año 2020. Asimismo, realizaremos un análisis sobre los criterios jurisprudenciales asentados en torno a la legitimidad de estas medidas y los parámetros de necesario cumplimiento en su práctica.

  Body investigation measures are «restrictive measures of fundamental rights that, specifically, involve interference with people’s bodies». Traditionally, constitutional jurisprudence has distinguished between inspections and bodily interventions. Because of the heterogeneity of assumptions, this work will focus on research measures that have the human body as their objective in the field of Criminal Procedural Law. On the one hand, we will focus on the current regulations and the future projection of their regulation, with reference to the new Draft Criminal Procedure Law of the year 2020. Moreover, we will carry out an analysis of the jurisprudential criteria established around the legitimacy of these measures and the parameters of necessary compliance in their practice.
