    El presente trabajo analiza el estado actual de disciplinas tales como la victimología y dogmática jurídico penal, para responder las siguientes preguntas ¿puede el animal no humano ser considerado víctima de delito? ¿Es el animal no humano víctima de delito en Chile? ¿Qué consecuencias trae esto? ¿Son necesarias reformas legales para mejorar la protección penal del animal no humano en este aspecto? Se explicará cual es el rol que los animales no humanos deben tener en nuestras sociedades, en relación con su consideración moral, así como también la urgencia de abordar el maltrato animal, en cuanto violencia contra seres sintientes. Además, se revisará el estado actual del derecho animal en Chile, en particular sobre la protección penal del animal no humano, con referencia a legislaciones comparadas como la argentina, colombiana y española en aspectos relevantes, exponiendo motivos para considerar al animal no humano como víctima de delitos. Por último, se abordará el concepto de víctima, su recepción en el derecho chileno, para luego plantear la tesis que se defiende en el presente trabajo: el animal no humano puede ser considerado víctima de delito en Chile.

    This paper examines the current state of disciplines such as victimology and criminal legal doctrine in Chile, to answer the following questions: can the non-human animal be considered a victim of crime? Is the non-human animal a victim of crime in Chile? What consequences does this bring? Are legal reforms necessary to improve the legal protection of the non-human animal in this field? The paper describes the place that non-human animals should have in our societies, in relation to their moral consideration, as well as the need to treat animal abuse as violence against sentient beings. In addition, the current state of animal law in Chile will be reviewed, including the legal protection of the non-human animal by criminal law, referring to Argentine, Colombian, and Spanish legislations on relevant topics, and explaining the reasons to consider the non-human animal as a victim of crimes. Finally, the concept of victim and its reception in Chilean law will be discussed, to present the thesis defended in this paper that the non-human animal can be considered a victim of crime in Chile.
