Situación de la niñez indígena en el Paraguay durante el año 2023: Análisis comparado con la legislación boliviana

    La situación de la niñez indígena en Paraguay es variada y compleja, pues a menudo se enfrentan a barreras culturales, lingüísticas y económicas que impactan negativamente en su bienestar y desarrollo. En este trabajo se aborda la problemática desde el contexto social y legal, se estudia y analiza su condición de vulnerabilidad, así como las leyes de protección nacional e internacional, además se da a conocer las instituciones intervinientes en materia de niñez y adolescencia, y se realiza una comparación con la legislación boliviana. En cuanto al método utilizado fue de tipo documental, de enfoque cualitativo, con diseño no experimental y de alcance descriptivo. Como técnica de recolección de datos se utilizó el análisis documental a través de la revisión bibliográfica de fuentes abiertas primarias y secundarias. Entre los hallazgos másimportantes se resaltan: la pobreza extrema, la falta de infraestructura adecuada a su condición que dificulta el acceso a servicios básicos como la educación y la salud, razones por las cuales estos menores se ven obligados a abandonar sus hogares en busca de mejores oportunidades, y al no lograr, pasan a deambular por las calles de diferentes territorios a nivel nacional, expuestos a situaciones como la vulnerabilidad, la precariedad, la discriminación y marginación. Es necesario abordar la problemática de estas comunidades, preservar su identidad cultural, garantizar sus derechos y visibilizar dicha situación, a través de la implementación de políticas inclusivas y coordinadas entre el Estado, las organizaciones gubernamentales, comunidades indígenas y la sociedad civil.

    The situation of indigenous children in Paraguay is varied and complex, as they often face cultural, linguistic and economic barriers that have a negative impact on their well-being and development. This paper addresses the problem from the social and legal context, studies and analyzes their condition of vulnerability, as well as national and international protection laws, and also provides information on the institutions involved in the field of childhood and adolescence, and makes a comparison with Bolivian legislation. The method used was documentary, qualitative, with a non-experimental design and descriptive scope. The data collection technique used was documentary analysis through a bibliographic review of open primary and secondary sources. Among the most important findings, the following stand out: extreme poverty, lack of adequate infrastructure for their condition that hinders access to basic services such as education and health, reasons why these children and adolescents are forced to leave their homes in search of better opportunities, and when they do not succeed, they wander the streets of different territories nationwide, exposed to situations such as vulnerability, precariousness, discrimination and marginalization. It is necessary to address the problems of these communities, preserve their cultural identity, guarantee their rights and make this situation visible, through the implementation of inclusive and coordinated policies between the State, governmental organizations, indigenous communities and civil society
