El objetivo principal del presente artículo es tratar de identificar los más significativos obstáculos que el iushistoriador debe superar al objeto de analizar la dimensión temporal del derecho en las diferentes épocas en las que puede dividirse la historia jurídica occidental.
Es, pues, una reflexión eminentemente historiográfica, centrada en demostrar, con ejemplos tanto europeos como hispánicos, la imposible traducción pre-moderna de los términos retroactividad/irretroactividad, identificando su emergencia con la sustitución de un concepto material de ley por otro formal.

The main objective of this article is to try to identify the most significant obstacles that the legal historian must overcome in order to analyze the temporal dimension of law in the different periods into which Western legal history can be divided. It is, therefore, an eminently historiographical reflection, focused on demonstrating, with both European and Hispanic examples, the impossible pre-modern translation of the terms retroactivity/irretroactivity, identifying its emergence with the substitution of a material concept of law for another formal one.
