Resumen de Organizaciones criminales: la intimidación como estrategia del poder

  Las organizaciones criminales, se han convertido, al día de hoy, en el fenómeno que más cuestiona a las sociedades actuales, como a las disciplinas del Derecho y su doctrina jurídico-penal y procesal penal. Si bien es cierto, que comienzan como grupos delincuenciales comunes, terminan siendo una sociedad paralela que busca operar dentro y fuera del Estado, involucrando estructuras autorreguladas normativamente, complejas, disciplinadas y muchas veces contagiando la clase política.

        En este sentido, la delincuencia organizada es uno de los problemas más graves por los que atraviesa el mundo globalizado, en atención a sus crímenes trasnacionales de toda índole, el dominio territorial, económico, militar y hasta tecnológico; lo que las convierte en una amenaza para la estabilidad de las naciones, sus relaciones internacionales y los derechos humanos.

        Las características que rodean e identifican a las organizaciones criminales, así como las que las diferencian, dificultan las investigaciones penales, su procesamiento y desmantelamiento dada la facilidad, que tienen para penetrar las fronteras físicas, en la red y a la inmersión en actividades legales o con apariencia de legalidad; siempre en atención a sus necesidades de expansión y control, características que les son propias.

      Con base en lo anterior, se puede decir que, las estructuras organizadas de criminalidad, permean todos los ámbitos sociales, cubriendo con su manto de la corrupción a políticos y empresarios, desestabilizando la naciones desde el seno de su institucionalidad, haciendo del alma del Estado un paraestado, incapacitado para su control jurídico-penal, disciplinario y administrativo, so pena de tener que condenarse a sí mismo, posibilitando una puerta a las reflexiones de conveniencia política, económica y éticas; en aras de hacer reconocimientos vergonzosos y graves que desestabilizan las relaciones internacionales y las relaciones instituciones del Estado.

    Se está de cara a una epidemia mortal y mundial, que obliga a conocer sus elementos, características, génesis, desarrollo y mutaciones. Impone a estructurar estrategias y figuras internacionales de tipo jurídico-políticas, entre otros; para evitar que sigan creciendo, evolucionando y planeando nuevas estrategias de cooperación, alianzas, reorganización y fusión entre ellas; haciendo imposible el ejercicio de control jurídico-penal para su desmantelamiento. Es innegable que se hacen cosas para evitar su aumento. Sin embargo, aún falta mucho por hacer, lo que permite que estas estructuras ilegales le lleven la delantera a los Estados.

  The criminal organizations, they have become, today, in the phenomenon that more questions to current societies, as the disciplines of law and its legal doctrine-and criminal. While it is true that begin as common criminal groups, they end up being a parallel society that seeks to operate within and outside the State, involving complex structures, self-regulating normatively, disciplined, and many times spreading the political class.

    In this sense, organized crime is one of the most serious problems facing the globalized world, in attention to their transnational crimes of all kinds, the territorial dominion, economic, military, and up to technological development; which makes them a threat to the stability of nations, its international relations and human rights.

    The features that surround and identify the criminal organizations, as well as those that differentiate them, hinder criminal investigations, processing and dismantling given the ease, they have to penetrate the physical boundaries, in the network, and to immersion in legal activities or with the appearance of legality; always in attention to their needs for expansion and control, characteristics which belong to them.

    Based on the above, it can be said that organized crime structures permeate all social spheres, covering politicians and businessmen with their mantle of corruption, destabilizing nations from the center of their institutionality, making the soul of the State a parastate, incapacitated for its legal-penal, disciplinary and administrative control, under penalty of having to condemn oneself, allowing a door to the reflections of political, economic and ethical convenience; for the sake of making shameful and serious recognitions that destabilize international relations and institutional relations of the State.

    It is facing a deadly epidemic and global, which obliges us to know its elements, features, genesis, development and mutations. Requires structuring strategies and international figures of a legal-political, among others; to prevent them from growing, evolving and planning new strategies of cooperation, alliances, reorganization and merger between them; making it impossible for the exercise of control of criminal prosecution for its dismantling.
