Resumen de Tejiendo derechos individuales y colectivos: el lenguaje de derechos presente en las peticiones de mujeres ante la Convención Constituyente de 1949 y sus experiencias previas a la reforma (1946-1949)

La historia constitucional del derecho invisibiliza ciertos actores parte de la reforma constitucional de 1949. Analizando las peticiones de mujeres presentadas al Congreso de la Nación y la Asamblea Constituyente, el trabajo indaga cómo durante el primer peronismo esos grupos articularon sus demandas individuales con reclamos colectivos, en tiempos donde la noción liberal de los derechos fue desafiada constitucionalmente, resaltando el uso del lenguaje de derechos presente en sus demandas. Recurriremos al análisis documental enfocándonos en perspectivas “desde abajo” de la historia crítica del derecho que acentúen el rol de estos actores en la reforma y sus estrategias de participación.

Law ́s constitutional history keeps away certain actors part of the 1949 constitutional reform. Analyzing women's petitions to the National Congress and the Constituent Assembly, this paper investigates how, during the first Peronism, these groups linked their individual demands with collectives claims, in times where the liberal notion of rights was constitutionally challenged, highlighting the use of rights language present in their demands. We will resort to documentary analysis focusing on perspectives "from below" that emphasize the role of these other actors in the reform, bringing back their participation strategies.
