Resumen de O princípio da afetividade nas relações familiares

  A Constituição Federal de 1988 igualou homens e mulheres, tendo o princípio da igualdade atingido também as relações familiares, proclamou também que não importa a origem, os filhos terão os mesmos direitos. Logo após, surgiu o afeto como elemento formador das entidades familiares. Esses princípios, quando aplicados conjuntamente, trazem deveres aos pais, como o dever de cuidado e de zelo. Indaga-se se o direito deve tutelar e como intervir nessas relações familiares, eis que em se tratando de família, a intervenção deve ser feita caso a caso. A afetividade é o que une os membros de um núcleo, podendo chamar este de família, sendo primordial para a criação e educação dos membros desta, em que é considerada a célula mater da sociedade. Foi utilizado nesta pesquisa o método dedutivo por meio de estudos da lei, doutrina, jurisprudência e artigos científicos que tratam do tema, demonstrando ao final a aplicação do princípio da afetividade nas relações familiares. Atualmente, o presente princípio se apresenta como fundamento de diversos julgados que reconhecem direitos a pessoa, se demonstrando ser um princípio relevante e de grande aplicação no poder judiciário.

  The Federal Constitution of 1988 equated men and women, with the principle of equality also affecting family relationships, and also proclaimed that no matter the origin, children will have the same rights. Soon after, affection emerged as a forming element of family entities. These principles, when applied together, bring duties to parents, such as the duty of care and zeal. It is asked whether the law should protect and how to intervene in these family relationships, as in the case of family, the intervention must be made on a case by case basis. Affection is what unites the members of a nucleus, being able to call it a family, being essential for the creation and education of the members of this nucleus, since it is considered the mater cell of society. The present research used the deductive method through studies of the law, doctrine, jurisprudence and scientific articles that deal with the theme, demonstrating in the end the application of the principle of affectivity in family relationships. Currently, this principle is presented as the basis of several judgments that recognize the rights of the person, demonstrating itself as a relevant principle and of great application in the judiciary.
