Il saggio, muovendo dalla compatibilità con l'art. 112 Cost. della prescrizione dell'azione penale, intende evidenziare come l'improcedibilità derivante dal decorso del tempo si riveli uno strumento effettivamente capace di concorrere ad assicurare la ragionevole durata del processo, ponendo in luce le necessarie garanzie di contesto che ne devono accompagnare l'introduzione.
