El artículo presenta las tres principales dimensiones que comprenden los argumentos que son invocados por las cortes y los tribunales constitucionales con el fin de autoexcluirse o de ejecutar una deferencia legislativa que inhibe el control constitucional de las normas. El análisis de cada dimensión permite entender los conceptos y tesis que fundamentan la posición con el fin de estudiar si resultan coherentes con la Constitución como norma suprema.
This paper analyses three dimensions that courts and judges use in order to execute a self restraint and a legislative deference in judicial review of legislation and amendments. Each dimension shows the concepts and thesis that are the background of the self restraint. However, the study of the dimensions make possible to understand if they are coherent with the Constitution as a fundamental law.
