La (in)necesaria regulación del miedo insuperable como eximente de responsabilidad penal autónoma

    El presente trabajo analiza la regulación autónoma, efectuada por el Código Penal español, del miedo insuperable como causa eximente de la responsabilidad penal, en atención a su controvertida naturaleza jurídica, al estar ante una debatida institución aparentemente híbrida que, pese a que funcionalmente se asemeja y deriva del estado de necesidad justificante, si se atiende al significado de su propia denominación la misma no sería más que la individualización de una de las diferentes causas de inimputabilidad existentes. De hecho, se apostará por una comprensión que se aproxima a su configuración como una alteración psíquica temporal o transitoria, con base en los conocimientos que la Neurociencia nos brinda respecto de esta emoción, en aras de posibilitar un mejor entendimiento de esta figura.

    This paper analyzes the autonomous regulation, carried out by the Spanish Criminal Code, of unbeatable fear as an excuse of criminal liability, since its legal nature is truly controversial, since it is an apparently hybrid controversial figure which, although functionally it resembles and derives from the state of justifying necessity, if the meaning of its own denomination is taken into account, it would be nothing more than the individualization of one of the different existing causes of unimputability. In fact, we will bet on an understanding that approaches its configuration as a temporary or transitory psychic alteration, based on the knowledge that Neuroscience provides us with respect to this emotion, in order to enable a better understanding of this figure.
