    Un presupuesto básico de la responsabilidad extracontractual por hecho ajeno es que entre elprincipal y el dependiente exista una relación tal que justifique la imposición de responsabilidadal primero por el hecho del segundo. En este artículo se propone que, a base de su naturaleza,la relación entre principal y dependiente puede ser dividida en dos series: relaciones fundadasen el servicio y relaciones fundadas en el cuidado. Esta distinción es clave para la adecuadaestructuración de la responsabilidad por hecho ajeno.

    A basic presupposition of the liability for the torts of others is that there is a relationship betweenthe principal and the dependent that justifies the imposition of liability on the former for the actof the latter. In this article it is proposed that, on the basis of its nature, the relationship betweenprincipal and dependent can be divided into two series: service-based relationships and care-basedrelationships. This distinction is key to the proper structuring of liability for acts of others.
