El proceso constituyente chileno 2021-2022: reflexiones desde el constitucionalismo de género

    Este artículo analiza las dimensiones de género del proceso constituyente chileno 2021-2002.Nuestra investigación busca verificar si en ese proceso se replican los hallazgos de la literaturaen relación con los distintos aspectos de la incursión de las mujeres en los procesos constituyentesy, a partir de la información obtenida, ofrecer una interpretación coherente e informada por losmarcos teóricos utilizados en el proyecto. Trabajamos con tres hipótesis que fueron corroboradas.La primera es que el discurso acerca de democracia de la Convención superaría el modelo representativoelectoral tradicional y adoptaría postulados de los modelos de democracia deliberativa,participativa y paritaria. La segunda, es que prevalecería una concepción de igualdad sustantiva.La tercera, es que habría un alejamiento del feminismo liberal, ganando protagonismo visionesfeministas radicales e interseccionales, y que las feministas impulsarían conjuntamente unavariedad de propuestas, pero que en ciertos temas se dividirían por razones ideológicas.

    This article analyzes the gender dimensions of the Chilean constituent process 2021-2002. Ourresearch seeks to verify whether the findings of the literature in relation to the different aspects ofwomen’s participation in the constituent processes are replicated in this process and, based on theinformation obtained, to offer a coherent interpretation informed by the theoretical frameworksused in the project. We worked with three hypotheses that were confirmed: The first is that theConvention’s discourse on democracy would replace the traditional representative electoral modeland would adopt features of the deliberative, participatory and parity models of democracy.The second is that a conception of substantive equality would prevail. The third is that therewould be a shift away from liberal feminism, with radical and intersectional feminist visionsgaining prominence, and that feminists would jointly promote a series of proposals, but that oncertain issues they would divide for ideological reasons.
